Case Note MORRISON v JENKINS (1949) 80 CLR 626
Case Note MORRISON v JENKINS (1949) 80 CLR 626 Case Note On MORRISON v. JENKINS (1949) 80 CLR 626 (Whose baby case) Name of Court: High Court of Australia Name of Case: MORRISON v. JENKINS Citation: (1949) 80 CLR 626 Parties to the Action: Alberta Gwen Morrison, the Appeallant Jessie Jenkins, the Respondent Nature of Case: Civil Matter (Family Matter) Date of Judgement: Date of Decision: 22nd December, 1949 Bench: Five Judges Bench (Large/Full) including Chief Justice. Mr. Latham CJ, (dissenting) Mr. Rich J, Mr. Dixon J, Mr. McTiernan J, (dissenting) Mr. Webb, J. Facts and Summary: Mrs. Alberta Gwen Morrison gave a birth of a baby girl on 22nd June 1945 in the ââ¬ËKyneton Hospitalââ¬â¢ in Victoria. On that same day, within five minutes another lady named Mrs. Jessie Jenkins also gave a birth to a baby girl in the same ward. Mr. and Mrs. Morrison claimed that their baby girl had been swapped in the ward with the baby girl of Mrs. Jenkins. And Mrs. Jenkins had left the hospital with their baby (baby named Nola Jenkins). After four years, this matter reached to the high court with completion of all lower court proceedings. Mr. and Mrs Morrison wanted the back of their baby Nola, but the Jenkins family did not want to return Nola because they were convinced that they Nola was their baby and they had brought a child right from the hospital. At that time, there was no DNA testing, but from the report of blood test showed that Mr. Morrison could not be father of the baby which they had had from the Victoria Hospital. After that, the Supreme Court of Victoria held in this matter that the baby girl (Nola) was the daughter of Mr. and Mrs. Morrison and Jenkins Family should be return Nola to custody of her real parents. The decisions and judgments of judges in the high court were divided. On the one part, Mr. Justice Rich and Mr. Justice Dixon said that the status of parentage of a child is so much doubt ful as wll as itfavorable be in the favourable circumstance for the child to return child to her original parent from persent custody parent. On the second part, Mr. Justice Webb did not agree with the decision of the tarial judge that the baby girl belonged to Morrisonsââ¬â¢ family. There was an evidence which included another fact which was that the within twenty four hours there was more children born and might be one of those have been given to Morrison family. On the third part, Chief Justice Latham and Mr. Justice McTiernan said that Nola should be given back to Morrison family. According to Mr. Justice McTiernan, blood test is a enough evidence for proving that Nola is the child of Mr. Morrison. He also explained that The test of ââ¬Å"best-interest-of-the-childâ⬠only applied when parents fight with each other for the custody of minor, but in this situation parents are together and real parents are natural and lawful guardian of their own child and also have an absolute legal right to the custody of their own child. The majority of judgesââ¬â¢ decision were that Jenkins family should retain the custody of Minor child Nola and Morrisonsââ¬â¢s family should retain custody of Johanne. And in the result, the appeal was refused. Brief Judgement/Decision of Trail Court/High Court: The decision by the supreme court of Victoria (Barry.J) regarding above said matter is that Nola was the daughter of Mr. Morrison and the welfare of children is that to leave and brought up with her own real parent because real parent can take care better than others. Nola should in the custody of her real parents. According to Herring C.J, the writ of habeus corpus is un suitable of this proceeding because this is a proceeding for the determination of the parentage of child but application for the habeus corpus is much suitable procedure because oarents wants to obtain the custody of their own child. According to Fullage.J. there is benefit of doubt as the parantge of the child even no order should be made if a slightest doubt is occurring. Low J. Agreed by all other members of the bench. Relevant law: Legitimacy Declaration Act 1858 section 1 The Marriage Acts 1928-1941 (Vict.), s. 136 are derived from the English Guardianship of Infants Act 1925 Halsbury, Laws of England, 2nd ed ., vol. XVII., p. 666 Section 136 of the Marriages Acts 1928-1941 (Victoria) provide that the court have power to decide the question of custody of minor regarding the welfare as the first essentio consideration. Halsbury, Laws of England, 2nd ed ., vol. XVII., p. 666 stated that ââ¬Å"a father, whose infant child is not in his custody, and a mother, where she is entitled to the custody, may, in the absence of good reason to the contrary, obtain the custody of the child by a writ of habeas corpus According to Issue: The main issues in this case were that: Whether is this matter relating to guardianship or parentage? Whether is it the welfare of child or not to change the guardianship? Whether is there defacto relationship has existed between child and present guardian? Whether appeal should be allowed or not? Which parents have custody right on the child? Whether comman law applied on this matter? Whether Nola is legitimate child of Mr. and Mr. Morrison? Ratio Decidendi: There are two points in which determines the judgment of all judges that is: That the welfare of child is more important than anything and welfare of child is a paramount consideration. That the Parentage of child is ligitimate. According to Mr. Latham, that this is a welfare of the child that he or she should be brought up with and by its real parents not other than and should be in the custody of her real parents. And Mr Latham fully supports the judgment of Mr. Barry J the Judge of Supreme Court of Victoria. He also mentioned the affidavit of Mr. Morrison in the trial court proceedings that Mrs. Morrion gave evidence that she never ever had any sexual relationship with any person except her husband. And Johanne Lee is not a child of her husband. Mr. Rich J, stated that the one thing which is more important after parentage issue that is welfare of child. In this matter the de-facto relationship has formed between the both parents and children and they have also defacto relationship exists between siblings and other family members. McTiernan J. relied on the scientific evidence which was blood test. He also mentioned that the natural parents are the lawful guardians of their own child and have right to custody. And they have the right of habeas corpus. He also state that the in the interest of welfare of child it is most important thing that parent should take care of their own child. Mr. Webb J. mentioned that both children are well developed and attractive but he was not able to check and observe the features of resemblance with parents and that kind could placed reliance on them. Mr. Dixon J. gives the opinion that this matter donot have any question of law and have only question of fact. According to him welfare of a child as a paramount consideration and never be neglected. He also fully support the view of the High Court that the whole future happiness and welfare of both child is on stake. Obiter Dicta / Notes: After the hearing of both parties; the leave to appeal dismisses by a a majority of three to two judges, Mr. Rich, Mr.Dixon and Mr.Webb JJ; Mr.Latham CJ and Mr. McTiernan J dissenting. All judges of court describe and set the standard of proof at very high level. Mr. Rich J. He stated that the Morrison must exclude ââ¬Ëevery other reasonable hypothesisââ¬â¢[1] Mr. Dixon J. He expressed his agreement with the view of the Victorian Full Court.[2] ââ¬Å"the further inference or conclusions which have been drawn as to the precise manner in which the babies were handled and exactly by whom are doubtful and in some respectsspeculative and they are unsafe.â⬠[3] Mr. McTiernan J. He stated that ââ¬Ëall reasonable doubtââ¬â¢ must be excluded. [4] Mr. Webb J. He was not prepared to go so far. His Honour stated that while a court cannot change the standard of proof, ââ¬Ëit can and should insist on exact or cogent proofs on issues of grave importance like that of parentageââ¬â¢.[5] Mr. Latham CJ , that the appeal should be allowed with costs, that the decision of the Full Court should be set aside and that the order of Barry J. should be restored.[6] Conclusion: In my point of view, This case is a family matter of guardianship as well as parentage. Morrison family wanted return their baby from the Jenkins family. There was sufficient evidence for proof that Mr. Morrision was the father of baby girl but the majority of judges of high court did not allow to gave custody of baby. So that guardianship of baby girl remaind status Quo. The evidences proves that the baby born on 22nd June 1945 and beloged to Mrs. Morrison. Affidavits and cross examinations as well as blood test of baby and Morrison also proves that the Nola is a legitimate child of Mr. Morrison but after all of these was not in the favour of child to change the guardianship and return to her real parent because there was defacto relationship existed and if court change the custody of the child then it may be harmful effect on child. This is very unusual and interesting case because this case treated as special case because there is no question of law included in this case. The case is depends upon question of fact rather then question of law and treated as a special case. Because in normal circumstances, father and mother fights for custody of the minor but in this case two different families were fighting for custody of the child. The Majority of judges agreed after examined the evidence that Mr. Morisson was a father of child but they focus on welfare of child rather than legitimacy of child. Colonial Society and Economy :: American America History
Colonial Society and Economy There were numerous effects of the French and Indian War; the Peace of Paris of 1763 ended the French and Indian War, closing all French power in North America. With the Death of King George II, the new English king, King George the III, wanted to put an end to the French and Indian War, pursuing peace and agreement. With this agreement, the Peace of Paris of 1763, came many stipulations. The French lost all of their land in North America. Many of the area settlers were forced to leave their homes, and many stayed behind to fight for their country. However, British rule was already set to dominate North America. Due to new government rule, King George III, peace was now the mindset of the English. After the Peace of Paris of 1763, land and possessions were divided among Britain and Spain. Britain got all of the French lands and possessions east of the Mississippi River and all of Florida which was owned by Spain. To make up for Spain losing Florida, they received Louisiana, which at that time was New Orleans and all the French land that was to the west of the Mississippi River. After allocating this land, the French had none left in North America. Also, in the West Indies, the French forfeited Tobago, Dominica, Grenada, and St. Vincent, which was most of what they had in the area. Basically, the Peace of Paris of 1763 left the French with nothing, and that was the goal. The people of the Americas were also effected by the ending of the French and Indian War. After the English received Spanish Florida, they invited all of the Spanish settlers to stay and continue practicing their religion, Spanish Catholicism, but most did not stay. The Spanish king had ordered the Spanish settlers to leave the colony and gave them all free transportation to Spanish owned lands in the Caribbean. Most of the Spanish settlers sold their property within a year at very low prices and moved to Mexico and Cuba. The French settlers, however, mainly stayed in the area. French authority roused them not to leave, but instead to stay in the now Spanish territory and work to create a movement against further English expansion. There were a great number of French settlers in the area because the French territory, Louisiana, was very large.

Internal Control and Home Improvement Essay
Loweââ¬â¢s Home Improvement is a chain of retail home improvement based in the United States. It was founded in 1946 in North Wilkesboro, North Carolina. Loweââ¬â¢s Home Improvement has expanded internationally into Mexico, Canada, and joint venture with Woolworths Limited in Australia. Loweââ¬â¢s Home Improvement ranked 54 in Fortune 500 for 2012, decreasing four spots in 2011 (ââ¬Å"Cnn money,â⬠2012). Loweââ¬â¢s Home Improvement is the second largest retail home improvement chain, behind The Home Depot. There are 1,724 Loweââ¬â¢s stores throughout United States, Canada, Mexico operating with more than 234,000 employees (ââ¬Å"Loweââ¬â¢s home improvement, 2012â⬠). Stakeholders are individuals, groups, or organizations that have a stake in the business. Stakeholders are categorize into two types: internal or external. Internal stakeholders can be owners, managers, and employees. External stakeholders can be suppliers, lenders, and customers (Worthington, 2009). Human Resource (Safety) There are many safety rules in Loweââ¬â¢s Home Improvement. ââ¬Å"We strive to sustain a safety culture that integrates safety into all parts of our business. Safety is a core value of our company. We hold our leadership teams accountable for creating and maintaining a safe environment to work and shop. Safety practices are incorporated into each job task, and we believe training is critical to ensuring safety awareness and knowledge are maintained at the highest levelâ⬠(ââ¬Å"Focusing on safety,â⬠2012, p. 1). When I was the Department Manager of Product Service, I was in charge of 70 percent of all resets in the store including display changes, merchandising refresh, and general product rotation. As an internal stakeholder (manager), I knew all the rules. However, some of these rules prevented me from accomplishing my job. Sometimes resets require me to get inside the bay to maneuver the products, beams, or shelves. This is strictly against Loweââ¬â¢s policy, which states I should get an order picker (machine to hold me up). I understand the need for the rules, but sometimes they cannot be followed exactly (prior thoughts as a Department Manager). If I were to get hurt while doing, Loweââ¬â¢s is liable for my injuries or death. Even though it clearly states it in our policy not to do these actions, it could not be proven that I was properly trained or ever informed about it. This is why it is important for all incidents to be reported. As an Assistant Store Manager, I must constantl y coach and train my associates and document (validate). I must ensure every decision my employees makes is what is best for the business. Employee incidents are known as workersââ¬â¢ comp claims that directly affect profitable. When the store reports the incident to our claims department, we are automatically deducted profits to pay for the expense. This can range from $10,000 to whatever. . Just recently, we had to pay for knee surgery for our outside sales representatives. Unfortunately, these claims can take many years to close, because the individual can continue to get treatment even after surgery. Typically, workers comp will attempt to pay the individual out before paying for surgery. If the individual accepts the buyout, they will lose their job. An external stakeholder is the customers that come in the building. Loweââ¬â¢s is just as liable for any injuries or damages caused to a customer as an employee is. Every morning an Assistant Store Manager must walk the Daily Safety Review (DSR) to verify the store is clean, clear, and safe. We must verify that all top stock, product, safety procedures, locks, and safety chains are up and operational. Recently, someone did not properly place a stack of trashcans in top stock. The trashcans were not standing on the tops and fell around 11:30am, luckily no customers or employees were hit with ten trashcans as they fell. Customer incidents are known as general liability claims that directly affect profitable. When the store reports the incident to our claims department, we are automatically deducted profits to pay for the expense. This can range from $2500 to $25,000. Anything over $25,000 is distributed among the rest of the district. To make up $2500 in pure profit is to sell roughly $6,000 when you calculate employee salary, utilities, and facility cost. Marketing (Deceptive Advertising) The Federal Trade Commission (FTC) oversees any deceptive claims of products or services. Recently, the FTC won a $40 million settlement against Sketchersââ¬â¢ toning shoes and apparel. Sketchers falsely represented clinic studies claiming their Shape-Ups, Toners, Tone-Ups, and Resistance Runners would help people lose weight, and tone and strengthen their butts, legs, and abdominal muscles. The most deceptive ad was used during Super Bowl featuring Kim Kardashian firing her personal training for a pair of Shape-Ups. Sketchers truly believed they would win the multiple lawsuits in different states, but choose to settle out for the ease of the company and individuals (Bachman, 2012). Deceptive advertisement can negatively affect internal and external stakeholders. Customer service is the most important aspect of any business. Deceptive advertising can create a negative experience for customers, which directly affect employees. A bad customer service experience can dramatically cost any business thousands of dollars. The internet is the playground for anyone. This can create a bad reputation when individuals post on their Facebook, Twitter, or other social media sites. If a business loses its customers base, it cannot support its employees. Recently, at my Loweââ¬â¢s Store we had the state department conducting an internal audit on pricing. The last time this audit was done was in 2004. The audit required scanning 50 products and verifying the correct price is labeled. If the price was incorrect, this would be considered false advertisement or deceptive advertisement and Loweââ¬â¢s would be fine thousands of dollars. Fortunately, we passed the audit with no issues. Accounting (Unethical Practices) Accounting fraud will continue to happen if there is opportunity. There must be provisions that prevent opportunity. Olympus Corporation covered up $1.7 billion in accounting fraud. The three executives inflated companyââ¬â¢s net worth for five years. Three executives pleaded guilty to covering up and firing the chief executive who originally found the discrepancy. This is one of the largest corporate scandals in Japan. The United States put in place corporate governance reform after the Enron scandal. These unethical behaviors can result in lawsuits from shareholders. After the Enron scandal, Senator Paul Sarbanes and Representative Michael Oxley (Sarbanes-Oxley Act of 2002) pushed a law through that changed regulation of financial practices and governance of corporations. Internal stakeholders have large investments into their company. First, it is their livelihood. Second, they could own company stock. Lastly, if the corporation goes under what value does that company add to the individuals resume? Employees of large corporation rarely see their importance in the big picture of things. The employees build companies. No matter how low your position is you can directly affect the business positively or negatively. As managers it is my job to ensure that my employees are align with the companyââ¬â¢s vision and mission. External stakeholders can also be affected by unethical accounting practices. The most obvious example would be if the customer were also a stakeholder in shares. This can directly affect the value of the stock. Another example would be customers affected in small towns. For example, if in their small town there is no other hardware store but Loweââ¬â¢s Home Improvement. What would happen if that Loweââ¬â¢s store closed, where would citizens of the town go to get their supplies? How much farther would they have to travel? This creates a huge inconvenience and provides opportunity for other small convenience/gas stores charge more for product. Conclusion Awareness is the number one preventer in safety issues. Companies must develop incentives for employees to remain and operate safely. At Loweââ¬â¢s if, a store goes 60 days accident free, there is a cook out that is hosted by the store. One time at my store, we went 265 days accident free, we held the highest accident free days in the division. Companies must develop and promote these incentives for employees to remain safe. This includes knowing when to get help and when to do it yourself. The saying ââ¬Å"work smarter not harderâ⬠must be in every employees forefront. Deceptive advertising is typically dealt with at corporate levels in retail. However, these corporations typically do not deal with the problem. The store level associates deal with the deception. At Loweââ¬â¢s, we are told to take care of the customer. Depending on the situation, as managers we may be able to substitute items to appease the customer. I believe there should be a separate department that evaluates all marketing and advertisements. This may save the company millions of dollars from lawsuits of deceptive advertisements. Companies that violate these ethics share common elements. Three common elements enable individuals to violate ethical or criminal misconduct in a corporation. 1. The availability of an opportunity 2. The existence of some form of pressure leading to an incentive 3. The capacity to rationalize. These three elements are arranged in a pyramid. Opportunity is the top of the pyramid. Opportunity is at the top because without opportunity nothing would exist. To reduce or eliminate opportunity, companies must implement effective internal controls. These can include policies and procedures, audits, and departments who oversee (checks and balances). The best example of these internal procedures is a bank securing its money in a safe. These are designed to keep unwanted people out. Pressure is located at the bottom left corner. Pressure can come from managers using intimidation, family expectations (standard of living), personal vices, and poor decision-making. For example, a manager may use intimidation and say, ââ¬Å"You will be fired if you do not achieve your sales numbersâ⬠. This type of pressure can cause certain employees to go too far. The last element is rationalization located at the bottom right corner. The individuals we are talking about do not think they are evil; rather they justify their own misconduct. Some rationalization would be everyone does it, I deserve this, I am only borrowing the money, and the company can afford it. Unfortunately, there will be individuals who cross the ethical line. It takes the personal integrity of an individual to resist the opportunity. The best indicator of these individuals is there past performances (ââ¬Å"Fundamental managerial accountingâ⬠, 2006). To fix these issues requires appropriate checks and balances. Corporations must ensure they have policies and procedures to prevent such opportunities from existing. In addition, these policies must be validated consistently and frequently. References Bachman, K. (2012, May 16). Sketchers settle deceptive ad case with FTC for $40m. Human Resources Perspective Essay
Introduction For small and large businesses alike, the human resources or personnel function can be helpful for much more than simply processing payroll or handling the open enrollment season once a year. Human resources plays an essential role in developing a companyââ¬â¢s strategy as well as handling the employee activities of an organization. Human resources can also provide human capital value to the organization, such as Utiliscan. Without this, a company is at potential risk for lost profits. Budget control is another primary function of human resources. This prevents excessive spending, through developing methods for keeping the workforce associated cost within perspective of the companyââ¬â¢s goals. This also includes negotiating rates for benefits and health care coverage in conjunction with setting competitive and realistic wages. Throughout the remainder of this paper, we will discuss the results of Utiliscanââ¬â¢s employee survey and what steps Paul could have taken toward improving Utiliscan as the Human Resource Director. Survey Results Are In Upon completion of every survey, it is important to post the results for all employees and management to see. The results should be consolidated with a task assigned and a well-developed plan of action. This is an opportunity to develop the corps values of the company leadership, as well, build growth within the company. Take the time to prioritize company goals, to include expectations of the employer and employees. Tackle the big and the ugly up front by making a statement. After all, your goal is to make the company successful and show growth through opportunity. Result #1: 56% of Utiliscan felt their benefits were below average or poor. Task: Identify comparable benefits packages to meet the company needs asà well the employee Action: Studying the labor market, employment trends and salary analysis based on job functions will assist Paul with Utiliscan, as it is a small business, creating budget constraints. . As the human resources director, Paul should negotiate better rates. His responsibility is to find health coverage and offer package incentives to his employees. A good example of this, high quality insurance that includes low premiums for his employees with high percentage rates of protection. American Blue Cross Blue Shield provides medical, dental, and hearing protection at reasonable rates for companies. Aside from medical requirements, Paul should address salary, wages and retirement benefits packages with his employees. Fidelity is an example of a investment firm that allows parole deductions for employees to save money and earn market based profits and well stock option growth. Many companies in modern America now provide a 401k match plan. 5% to 6% match is a good comparable rate to start with. Result #2: 55% felt safe, with little danger of occupational hazards associated with their physical environment. There were comments, presumably from the 45% who did not feel safe, that some of the utility plants where they worked on installations were not as safe as they should be. Task: Identify safety hazards within and around the work environment. Action: Conduct training and development of employees and supervisors. Needs assessments for the organizationââ¬â¢s current workforce to determine the type of skills training and employee development are necessary to improve skill sets. This includes qualifications, licensing and documentation of certifications. A company such as Utiliscan must ensure their employees meet specifications to insure quality productions levels, at the same time improving overall safety of the organization. Many companies identify hazards within the workplace and address them through education of their employees. It is much less expensive than the cost to hire additional staff or more qualified candidates. In addition, itââ¬â¢s a strategy that also can reduce turnover and improve employee retention. Result #3: 74% felt there was little relationship between their performance and their pay. There were numerous comments that performance reviews hadnââ¬â¢t been done on time or hadnââ¬â¢t been done at all. Other comments indicated arbitrary treatment and favoritism of some employees. Task: Identify the root cause for lack of performance appraisals and employee development programs. Build and mentorship programà to better support Utiliscanââ¬â¢s employee foundation. Action: Through Performance Improvement, Training and Development Paul can develop performance management tools. This will enable Paul and his managers to measure the performance of their employees and provide feedba ck. This is a developmental tool to improve the employee skills and expertise. If performance appraisals are not completed then the potential for employees whose performance to fall below the employerââ¬â¢s expectations can continue. This leads to waste through payroll activities and low-performance employees. Performance appraisals should be conducted monthly or quarterly with a final annual appraisal to determine potential for promotion or retain ability. Result #4: 89% felt there were few if any opportunities to improve their skills and 87% responded there were no promotion opportunities. Task: Develop a mentorship program and identify key developmental positions that will be forecasted. Action: Paul can focus his efforts toward performance management systems. Constructing a plan that measures performance, employees develop specified skill sets in order to become more qualified for potential promotion opportunities. At the same time, Paul can begin succession planning. This enables the company to identify key potential candidates to fill key developmental positon. This is done through identifying employees with the promise and requisite capabilities to eventually transition into leadership roles with the compa ny. This is an important function as it can guarantee the organizationââ¬â¢s stability and future success. Result # 5: 78% of the employees were satisfied with their working conditions and they enjoyed freedom and flexibility to perform their jobs without strict supervision. 70% felt their workloads were adequate ââ¬â not too heavy, not too light Task: Despite the overall content attitude toward working conditions and enjoyment of the employees daily work routines, there is always ways to improve the overall employeeââ¬â¢s satisfaction. Identify a way to seek employeeââ¬â¢s thoughts and ideas of how to make the work place a better environment. Action: Over all employee satisfaction can better the work place and improve the quality of life within the company. Happy employees work harder and produce more. This leads to more money for the company to grow. Paul should place a suggestion box to assist in identifying key components that his employees are requesting to make their work experience better. Some of their ideas mayà lead to greater levels of quality, production, and even profits. Another option is to continue with carefully designed employee surveys, focus groups and an exit interview strategy to determine key components of employee dissatisfaction and addresses those issues to motivate employees. Corporate Image The employer who maintains steadfast principles, embraces change, accepts and breeds the companyââ¬â¢s philosophy and business principles will win every time. Businesses want to be known as the company to work for or ââ¬Å"Employer of Choiceâ⬠. This is the company that receives recognition for the way they take care of their employees and care for them. These are the companies that employees find balance. Paul working in human resources can develop the tools to identify balance through recruiting the most qualified applicants, selecting the most suitable candidates and retaining the most talented employees.
